The Warsaw District Prosecutor's Office reported on 6 January that the deceased was a 14-year-old Ukrainian national.

"The deceased is a citizen of Ukraine. The perpetrator is a Polish citizen. When a Radio Liberty reporter inquired whether the deceased was a Ukrainian with temporary protection status, the spokesperson replied that this would be established the following day after investigators had spoken with the victim’s mother.

The 43-year-old driver, Andrzej K., was detained on Saturday, 4 January, the day after the accident, while under the influence of alcohol. He works for a courier service. The prosecutor's office noted that he has a criminal record, including previous charges for drug possession and aiding illegal border crossings.

The driver has been charged with causing a fatal accident and fleeing the scene. If convicted, he will face a prison sentence of between 5 and 20 years.
