Ukrainian Justice Ministry comments on victory in European Court of Human Rights in case filed by Russia

The Ministry of Justice has recalled the details of Russia's lawsuit against Ukraine in the ECHR, in respect of which Moscow lost, and noted that this is a positive signal that the cases before the Court will continue to be considered, despite Russia's suspended membership in the Council of Europe.

Details: The Ministry of Justice pointed out that this was the only inter-state complaint against Ukraine. Russia filed it under ten sets of charges, alleging patterns [administrative practice] of "killings, abductions, forced displacement, interference with the right to vote, restrictions on the use of the Russian language and attacks on Russian embassies and consulates".

In this complaint, Russia also tried to blame Ukraine for the shooting down of MH17 in the skies over Donetsk and Luhansk oblasts since Ukraine "had failed to close its airspace".

Moscow also challenged the blocking of the North Crimean Canal and asked the ECHR to apply interim measures, including an obligation for Ukraine to resume water supply to Crimea and to stop "oppression" against the use of the Russian language.

"This case clearly proves Russia's attempts to present 'black as white', distort reality and shift responsibility for its own crimes to the party suffering from its own military aggression.

Strike out of the "Russian case" against Ukraine is another natural stage in the struggle to bring Russia to international legal responsibility for the crimes it committed against our country," said Marharyta Sokorenko, the Commissioner of the Ministry of Justice for the ECHR.

Ukraine’s Deputy Minister of Justice Iryna Mudra noted that Russia's ignoring of the court's requests after the spring of 2022 did not prevent the ECHR from deciding to further consider the cases against Russia that were in its proceedings without in any way restricting its rights.

"The ECHR has given a clear message that it will continue to administer justice," she said.

On 18 July, the ECHR dismissed in full all of Russia's claims against Ukraine under the complaint it filed in 2021.

The European Court of Human Rights has decided to continue considering cases against Russia, despite its expulsion from the Council of Europe shortly after the start of the full-scale invasion of Ukraine.
